LEGAL NOTICE AND GENERAL BOOKING TERMS AND CONDITIONS

2. TERMS OF USE OF THE WEBSITE AND INTELLECTUAL PROPERTY
Access to and use of this website confers the status of User and implies full acceptance of these terms and conditions.
Proper Use: The User agrees to make lawful and proper use of the website, refraining from making false or fraudulent reservations, introducing computer viruses, or using the portal for unlawful purposes.
Intellectual Property: All content on the website (text, photographs of the accommodations, logos, graphic design, software, and source code) is the exclusive property of Costa Golf Rentals S.L. or of third parties who have authorized its use. The unauthorized reproduction, distribution, or modification of any element of this website is expressly prohibited.
3. PRIVACY AND DATA PROTECTION (GDPR)
Costa Golf Rentals S.L. guarantees compliance with current regulations regarding the protection of personal data, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR), Organic Law 3/2018 on the Protection of Personal Data and the Guarantee of Digital Rights, as well as any other applicable regulations.
The personal data provided by users will be processed for the purpose of managing reservations, responding to inquiries, providing the contracted services, complying with applicable legal obligations, and maintaining the business relationship with customers.
Furthermore, when the user has given their express consent or there is a legal basis permitting it, Costa Golf Rentals S.L. may send commercial communications related to its services, promotions, available accommodations, real estate investment opportunities, and other activities carried out by the company.
The processing of personal data will be conducted confidentially and by adopting the necessary technical and organizational measures to ensure its security.

4. BOOKING TERMS, PAYMENT POLICY, AND CANCELLATIONS.
The reservation will be confirmed once the corresponding payment has been received and confirmation has been sent by Costa Golf Rentals S.L.
Costa Golf Rentals reserves the right to reject any reservation request when there are reasonable grounds to do so.
The published prices include only the items expressly indicated for each accommodation.
As this involves the booking of tourist accommodations and/or short-term stays for specific dates, the booking process will be governed by the following financial terms:
Payment Methods: Payments are accepted via Visa and Mastercard credit/debit cards through a secure payment gateway.
Payment Terms: To confirm the reservation, the User must pay 100% of the total amount at the time of confirmation.
5. CANCELLATION AND REFUND POLICY:
All reservations must be paid in full at the time of confirmation.
Since properties are taken off the market for the reserved dates and administrative and operational costs are incurred from the moment of booking, the following cancellation conditions apply:
Cancellations notified more than 30 days prior to the arrival date are entitled to a full refund of the amounts paid.
Cancellations notified 30 days or less prior to the arrival date will not be eligible for any refund.
In the event of a no-show, no refund will be issued.
Reservation Changes
Any request to change dates is subject to availability and express acceptance by Costa Golf Rentals S.L., and there is no obligation to accept changes once the reservation has been confirmed.
6. SECURITY DEPOSIT
To ensure the proper use and maintenance of the accommodation, as well as compliance with these terms and conditions, the guest must pay a security deposit equal to 30% of the total booking amount.
The security deposit will be charged at the time of booking confirmation along with the amount corresponding to the stay.
The security deposit is not part of the accommodation price and is intended to cover any potential damage, loss, breaches of the property rules, extraordinary cleaning costs, or any other damage caused during the stay.
Once the stay has ended, Costa Golf Rentals S.L. will conduct an inspection of the accommodation and the inventory.
If no issues are found, the security deposit will be refunded within a maximum of 15 business days from the date of departure.
If damage, loss, missing inventory items, or breaches of these terms and conditions are detected, Costa Golf Rentals S.L. may withhold all or part of the security deposit, notifying the guest of the applicable charges and providing, where applicable, the corresponding supporting documentation.
If the amount of the damages or losses incurred exceeds the amount of the security deposit, the guest will be responsible for paying the corresponding difference.
7. RULES OF USE, DAMAGE, LOSS, AND PENALTIES
To ensure a pleasant stay and respect for neighbors and homeowners’ associations, guests must comply with the following rules:
Smoking is prohibited inside the property.
The use of drugs or illegal substances is prohibited.
Hosting parties or events is prohibited.
It is not permitted to accommodate or invite people other than those listed on the reservation.
Guests must respect community rules and avoid making noise or causing disturbances to neighbors and residents.
Air conditioning, heating, and other electrical appliances must be turned off when the property is unoccupied.
Pets are permitted only with prior authorization from Costa Golf Rentals S.L. and may incur additional fees.
The pet owner is responsible for any damage, breakage, excessive dirt, or harm caused by the animal during the stay.
Pets may not be left alone in the property for extended periods or cause disturbances to neighbors or residents.
Failure to comply with any of these rules may result in the immediate termination of the stay, without the right to a refund, as well as the total or partial forfeiture of the security deposit.
The guest is responsible for the proper use and maintenance of the accommodation during their stay. Any negligent act will result in the deduction of the security deposit and, if the cost is higher, the guest will be charged the difference. Charges will apply in the following cases:
Loss of keys and remote controls: Minimum charge of €50 to €250 for replacement or lock change.
Damage to the property and furnishings: Repairs resulting from breakage or damage due to misuse.
Missing inventory: Deduction for the replacement value of the missing items.
Extra cleaning: Penalty of €100 to €500 if the accommodation is returned in a state of extreme dirtiness or with accumulated trash.
Smoking indoors: Penalty of €100 for deodorizing smoke-free areas.
Towels and linens: It is prohibited to use towels to remove makeup or for any purpose that causes permanent stains, damage, or deterioration. The loss, theft, breakage, deterioration, or staining of towels or any item of linens provided in the property will result in a charge of €20 per affected item.
Use of the sanitation system: It is strictly prohibited to flush wet wipes, sanitary pads, tampons, cotton swabs, paper towels, or any items other than toilet paper down the toilets or drains in the property. In the event of a blockage attributable to a violation of this rule, a minimum charge of €200 will apply, without prejudice to passing on the total cost of the repair if it is higher.
Remotes and control devices: Remotes for the air conditioning, television, parking, garage, gates, alarms, or other devices provided with the property must remain in the accommodation and be returned to the same place where they were handed over. The loss, theft, or damage of any of these devices will result in a charge of €100 per affected unit.
Parties and Overcrowding: These are strictly prohibited. They will result in immediate eviction without the right to a refund and the total loss of the security deposit.
Second set of keys: Requests for a second set of keys are subject to availability. An additional deposit of €50 will be required for each set requested, which will be refunded once the keys are returned in the same condition. Pickup and return must be done in person at the Costa Golf Rentals S.L. offices during regular business hours.
In the event of total or partial retention of the security deposit, the guest will receive a notice detailing the charges applied.
8. REPORTING ISSUES
To ensure the best experience and resolve issues quickly:
Issues at Check-in: Any irregularities or lack of cleanliness upon arrival must be reported within the first 24 hours.
During the Stay: Any malfunctions must be reported immediately upon detection.
After Check-out: Complaints must be reported within a reasonable timeframe following the end of the reservation. Failure to meet these deadlines during the stay limits Costa Golf Rentals S.L.’s ability to resolve the issue on-site.
9. CHECK-IN AND CHECK-OUT TIMES
Check-in: from 4:00 p.m.
Check-out: before 11:00 a.m.
Special check-in and check-out times are subject to availability and may incur additional charges.

10. MANDATORY GUEST REGISTRATION
All guests must provide the documentation required by Spanish law for the mandatory registration of travelers with the competent authorities.
Refusal to provide such documentation may result in the cancellation of the reservation without the right to a refund.
11. LIABILITY
Costa Golf Rentals S.L. shall not be liable for temporary interruptions in the supply of water, electricity, internet, telecommunications, or community services when such incidents are beyond its control.
Costa Golf Rentals S.L. shall not be liable for any loss, theft, or damage to guests’ personal belongings during their stay.
Items left behind in the accommodation will be held for a maximum of 30 days from the date of departure, provided that their safekeeping is reasonably possible.
If this period elapses without the items being claimed, Costa Golf Rentals S.L. may proceed to dispose of them without assuming any liability.
All shipping, pickup, or handling costs associated with the return of forgotten items will be borne entirely by the guest.
Furthermore, Costa Golf Rentals S.L. reserves the right, in exceptional circumstances and for reasons beyond its control that prevent the provision of the reserved accommodation, to relocate the guest to accommodation of similar or superior quality.
In the event that such relocation is not possible or is not accepted by the guest, Costa Golf Rentals S.L.’s liability shall be limited to the full refund of the amounts paid for the reservation, with no additional compensation for indirect damages, loss of profits, transportation costs, loss of vacation time, or any other damages claimed by the guest.
12. APPLICABLE LAW AND JURISDICTION
These terms and conditions shall be governed by Spanish law.
For any dispute arising from the interpretation or enforcement of these terms and conditions, the parties submit to the Courts and Tribunals of Marbella, unless applicable consumer and user protection regulations establish a different mandatory jurisdiction.
